Whether because of natural gifts or as devices for compensation and adaptation, these other abilities are dependent on the disabled persons. I enjoyed a video that we watched during one of the classes, in which a man working with a group of community leaders told them about what life and school is like for children who are disabled was an informative activity. One of his illustrations actually struck me when he contended that expecting something from those with disabilities who are not capable of accomplishing the set task    is commonplace in society and in school, which I agreed with. In addition, this problem has been found to lie with societal ignorance, rather than with individuals suffering from a disability (Stone, 2009). The main problem of white collar crime is that although some involve what would be called typical crimes such as fraud and insider dealing, corporate crime can include breaches of health and safety which can endanger human lives, in this aspect; corporate entrepreneurs may be s   ued for damages and subjected to various financial sanctions (and) are unlikely to face criminal prosecutions no matter how serious the consequences of their actionsà  [4]à   This why white collar crime is on the margins of criminological inquiry, because most of the time they never actually break the law, the crime itself is almost always classed as an accident Even though Corporate crimes are more dangerous, expensive and violent than regular crimes i.e. theft, assault, murders etc. According to William J Chambliss in his book Power, Politics and Crime written in 2001, the Joint Economic Committee of the U.S Congress estimated that $4 Billion was lost from street crimes while $200 billion was lost by corporate crime, 50 times more, although there is huge uncertainty in to white collar crime, the extent of the crimes have to be estimated, Levià  [5]à  estimated in 1985 that fraud alone was worth à £2,133 million  Another reason for corporate crime being in the margins is the separation of ownership of the company especially with a large amount of shareholders, it is almost impossible for one person to take control of a business dealings, with different levels of hierarchy, departments and regulating bodies, this can tempt corrupt executives to commit crime by offering big rewards with very little risk: large corporate crime i.e. crimes by large companies which effects many can affect many people such as employers, consumers, the environment etc., large scale criminal corporations I.e. fraud, money laundering etc., small scale criminal firms i.e. pretty crimes by small business such as dealers and tradesmen, occupational crime I.e. an employer committing crime, the important the employee the bigger the crime and finally other white collar crime which is individuals committing crime outside of the work place such as tax evasion. However as Croall points out, the attention seems to be on the off   enders rather than the crime they commit, she asks How can the rather vague terms high status and respectable by defined and operationalized?are only some to be counted as white collar offenders?. These types of crimes have many characteristics: Offences are invisible, they are very hard to detect, this also makes them hard to be prosecuted , offenders are often legitimately present at the scene of the crime and mostly the victims are slow to realise wrongdoing has been caused, the crimes are carried out under the cover of a legitimate company; the crimes are very technical and complicated, many offenders may be involved and it is very hard to pinpoint who caused the offence; a diffusion of responsibility (in a large group, responsibility is not assigned) is rife in these cases, employees can blame employers for not preventing incidents and not setting regulations while the employers cab blame the employees for ignoring instructions etc.; also, victimisation can be diffused, in some    cases there is no relationship between the offender and the victim i.e. an employers failure to check the safety of the safety of apparatus and causes and injury. All these categories result in the ambiguous criminal statusà  [6]à  of white collar crimes.  There are many problems in researching white collar crime, as Edwin Sunderland found out first hand, he could not publish the names of the companies in his studies in fear of being prosecuted himself for libel, there is the argument for this reason, it cannot be defined as crime seeing as criminologists cannot research it properly and efficiently. Statistics are very hard to find, seeing as most go undetected and do not fit legal offences, also victim surveys are almost non existent. As Croall points out, because there are so many offences hidden, it is very hard to get a sample of offenders for research, a large knowledge of the market and legal terms, the easiest way to conduct research is through individual case studies, investigative journalism, court observation and reports, cases reported in the mass media and interviews with enforcers. All the above is a huge contributing factor in why the crimes of the powerful are in the margins of criminological inquiry, if a criminologist    cannot conduct and valid, reliable study then these types of crimes will always stay outside of criminological inquiry.  However, as mentioned earlier, white collar crime is very diverse, and is, in many cases, extremely destructive and serious and should be in the centre of criminological inquiry. To begin with is offences against employees by employers, according to Muncie and McLaughlin, many employers will breach health and safety regulations for the employees just to meet deadlines and increase profits, 400 people a year in Britain die as a result of and accident in the workplace, in 1992 alone 28,000 people suffered serious accidents and 140,000 suffered minor ones. The main example of this is the Zeebrugge disasters in 1987 involving the capsize of the ferry Herald of Free Enterprise which killed 154 passengers and 38 crew members. The owners P  O Ferries international were blamed for not applying a safe operating system and for letting a deckhand fall asleep on the job. The families of those who suffered pressed the Director of Public Prosecutions to charge them with corporate manslaughter but it never happened. An investigation found that it was the companies fault for not giving clear instructions about safety procedures. After a second disaster involving the Estonia which killed 850 people, new safety measures were brought in 1997.  New safety measures were finally brought into effect in 1999 following a second ferry disaster. The Estonia sank in 1994 with the loss of 850 lives.  Offences against the public is a very serious category, with the huge rise in industrial development such as the use of coal, gas, oil and nuclear power, the risk of damage to the public and the environment has increased. The main example of this is the Union Carbide disaster in Bhopal in 1984 where a huge gas leak in a chemical plant let to approximately 15,000 deaths although the government claim 3,787 deaths, this is considered to be the worst industrial disaster in the world and possibly the worst corporate crime to date. The company who owned it, Union Carbide, were blamed for poor design of the plant, its placement near a shanty town housing thousands of people, its faulty safety devices and its awful condition generally. Pearce and Tombs conclude that Union Carbide created or allowed to develop the conditions whereby and accident was possibleà ¢Ã¢â ¬Ã ¦ (The company) had not taken the steps necessary to migrate the effects of the accident to this day thousands of families    have not received compensation, in 1991, the Indian government charged the CEO of union Carbide Warren Anderson with manslaughter. He never faced trial and evaded an international arrest warrant while Union Carbide was charged with homicide, yet these charges never followed through.  Another type of corporate crime is offences against other firms where one company will try to sabotage another company to maximise profits, and example of this is the case of Guinness takeover of Distillers in 1986. Guinness bid was contested by a bid from the Argyll group, to strengthen its bid, Guinness spent à £25 million on letting friends and associates by its own shares to increase its share price, they also bought a huge share in Distillers at an inflated price which it could honour its shareholders. The chief executive at the time Ernest Saunders and two other associates where found in breach of the Stock Exchange regulations and of criminal law and were prosecuted.  Finally are offences against the state, this can include corporate tax invasion or bribery. An example is a scandal that the surrounded the sales of engineering equipment from the British company Matrix Churchill to Iraq that could have been used by Britain just before the Gulf war in 1990. Ministers secretly encouraged them to do so while they used official secrecy regulations to avoid being punished.  These are all relevant examples to why criminology should focus more on white collar crime as a real crime, the examples given are huge crimes on a wide scale, they cannot compare to a petty theft at a newsagent, but there are worse cases, some companies main objective will be for crime, such as fraud, using the company as a disguise. The main example of this so-called mega fraud is the case of The Bank of Credit and Commerce international (BCCI) which was closed down in 1991 with à £10 billion worth of debts and 300,000 creditors world wide. The bank itself had very close links to Abu Dhabi. The bank would use the money deposited to estimate the stock markets and make loans to people, often fake, who lacked collateral to back them, and the losses were then concealed by taking out fake loans and raised $600 million. According to the media they were involved with tales of drug-money laundering, bankrolling of Middle East terrorists, underwriting of Saddam Husseins quest for a nuclear    bomb, etc. Yet there is such thing as petty frauds, which can occur outside the work place and outside the big corporations, this can include the sale of defective goods and providing unsatisfactory services e.g. illegal street traders selling counterfeit DVDs.  Another is occupational crime where an individual takes advantage of his/her position as an employer, the greater the responsibility borne by any particular employee, particularly in handling the money, the greater the scope of negligence or criminality (McLaughlin and Muncie 1996; 240). Finally is middle class crime where crime is committed outside of employment, notably tax evasion or insurance fraud conclusion, the main reason that white collar crime is on the margins of criminological inquiry is because society does not expect powerful respectable people to criminals, even though it occurs frequently the fact that it is so undetectable can make it hard for criminologists to even class it as a crime. The main reason this occurs is because of market forces and the desire for profit, something that does not affect average criminals. The difficulty of differentiating between the pursuit of legitimate commercial advantage and rule-breaking profiteering goes some way towards explaining    the differential response of the authorities and public opinion towards white-collar and ordinary crime (McLaughlin and Muncie 1996;262) added to the trouble in regulating the crime and its inclination to use sanctions rather than punishment, white collar crime at present cannot be central in criminological inquiry, perhaps in the future the justice system will realise this, most probably after a big disaster has occurred.

Young children, aged birth through approximately 8 years (young children, 2004) interact with one another to develop social and even motor skills that they will carry with them later in life.  Development in young children involves the early years in a child's physical, social-emotional, language, and cognitive development (Baur, 1998).    Developmental aspects can be assessed by technology.  Technology is growing everyday in our society, it is becoming a big factor in the use of early childhood education.    Computer use is most popular in the classroom because it is easy for children to learn and develop learning (Clements, 1992).  Computers increase social interaction and help children explore writing.  Until age eight, activity of young children is symbolic since they communicate with gestures, language, and play (Shade & Caruso, 1994).  The computer; therefore, provides a symbolic tool for children to use in school, which is very beneficial.  As technology is a useful aspect in early childhood education, there are also negative effects.  Overall, the use of technology in early childhood education has positive effects on children because it plays a major role in the learning development of young students from pre-school through out elementary school. Patent Nonuse and the Role of Public Interest as a Deterrent to Technology Suppression Essay
Patents are contracts between the society and the inventor to encourage development in the field of science and technology. It helps the society by enabling them to utilize this technology, and the inventor by protecting his rights and rewarding him appropriately for this intellectual efforts and innovations. Once a patent is given by the patent office, the inventor has to work the invention by himself or through somebody else by means of an assignment or a license. The patent office does not look at the potential commercial value of the invention whilst giving the patent.  The invention should have a specific use and should fulfill what it is meant to do. Many inventions given patents have turned to be commercial failures. However, there are several instances in which neither the patentee has worked the invention by himself, nor has he allowed others interested to do so. This is a very serious situation, because it goes against the very intention of granting the patent. The patent system grants patents only to those inventors who are willing to reveal their invention with others, so that it can benefit society.  Some patentees may not work their invention due to several reasons, one of which may be to wrongfully hide or suppress technology from the public. One of the first such cases was the Continental Paper Bag Co. v. Eastern Paper Bag Co. case of 1908. In this case, the patentee had invented a machine that could make a folded paper bag with a rectangular bottom. However, he had not made his invention available to the public, thus preventing others from working the invention. At that time, this invention was a breakthrough, and many people felt bad, because the very intention of giving a patent was not fulfilled.  No concrete rules regarding nonuse of patents and compulsory licenses were existent at that time, and everything was left at the mercy of the patent holder. Lower courts also found that the patentee was unreasonable. They in fact tried to draw a line between ââ¬Ëreasonable nonuse policyââ¬â¢ (inventor unable to use his invention because or some understandable problems) and ââ¬Ëunreasonable nonuse policyââ¬â¢ (purposefully suppressing technology). However, as no concrete rules existed at that time, the higher court had to give its decision in favor of the rightful owner of the invention.  Many breakthrough technologies exist which are being currently suppressed from the public. A plastic that is strong, long-lasting, and can be utilized to make houses that last forever, was granted patents, but not accessible to the public by the owner. New rubber for tires is invented which does not blow up. If this technology could be utilized currently, the lives of many people who die in road accidents could be saved. A new material has been invented for use in toothpastes, which protects the teeth from developing cavities. These technologies are being suppressed due to the anticompetitive intentions of their owners.  Some patentees may not use or license their technology so that others may be forced to infringe up on their patents. Lawsuits for infringements could be filed, which could give them earning in millions. An instance of this is a case between Minolta and Honeywellââ¬â¢s, in which Minolta had to pay $127 million to Honeywell for infringing their auto-focus camera patent, although the owners were not using their patent. The patent office should come up with strict rules such that all the patentees have to give an annual report of how their patent is being worked commercially, and in case it is not being worked, the reasons for the same.  In case the inventor does not respond, the patent should be revoked. Instances of patent nonuse can be used as evidence in the court, against individuals who indulge in anticompetitive practices. Such practices are strictly considered unlawful under the US Antitrust Laws. The Sherman Act was one of the first such as to protect against unfair trade practices. According to this act, any individual monopolizing or attempting to monopolize, or combines with other people or with other nations to monopolize any trade business in the US, shall be held guilty of an offense under the act.  Patent is a monopoly granted to the owner, but they are also contracts between the owner and the public, to permit the later to access the technology. Patent laws are likely to be misused. The exclusionary right (to prevent others from using or making the invention without the license of the owner) is limited and should be more meaningful. The patent system does not give absolute monopoly to the owners. In the case Pfizer V. Government of India [434 US 308 (1978)], the US permitted foreign nations to sue under the Section 4 of the Clayton Act.  The Government of India was asking Pfizer to grant licenses for certain broad spectrum antibiotics. However, the company refused to give reasonable licenses. Several antitrust violations such as price-fixing, fraud, market-division, etc were being imposed by the Indian Government against Pfizer and group. The respondents also said that petitioners were trying to limit and monopolize the production, sale and distribution of their patents. The respondents also said that these practices had destroyed businesses. The Company said that the Indian Government could not bring this case forward, as they belonged to another nation.  However, the court went on to say that foreign nations could also claim under antitrust laws. The court said that the case was similar to having a citizen having his rights under the antitrust laws being violated. In the case Remington Products V. North American Philips corporation [107 FRD 642, 1985], Remington alleged that the company Philips, a leading Dutch MNC, was indulging in anticompetitive behavior by not disclosing information needed to work the discovery. The defendant claimed that certain clauses in a Dutch statue did not permit disclosure.  However, the US court granted the case in favor of Remington saying that the defendant wrongfully withheld information regarding the discovery. The plaintiff had previously approached the defendant to provide information regarding the discovery. However, the defendant refused to give this information needed saying that the information was irrelevant. In the Chevron Research Companyââ¬â¢s patent [1970; RPC, 580], the court said that the patentee has to disclose full and relevant information regarding the patent. In the Image Technical Services V. Eastman Kodak Co. [504 U. S. 51 (1992)] provides an association between the antitrust laws and the intellectual property rights regime.  Kodak Company had a patent for a photographic device. The case was alleged by companies that serviced Kodakââ¬â¢s products. In this case, a distinction is being made between ââ¬Ëattempting monopolizationââ¬â¢ and ââ¬Ëattaining monopolizing by exploitingââ¬â¢. The court had to study the market situation to determine if the company was trying to control prices or destroy competition. Kodak in fact monopolized manufacture of components of its photographic equipment and even monopolized servicing of its equipment.  The court had said that both patents and copyrights did not come under antitrust laws. An inventor had the right to license or refuse license of his invention. However, a patent owner may be held for developing practices against the antitrust laws (that could destroy competition). The extent to which antitrust laws could be applied to patent laws had to be determined by studying the market situation. The plaintiffs had gathered enough proof that Kodak were trying to monopolize their market situation by limiting the availability of its components to the service companies  Nowadays, exclusive license holders may also try to misuse their rights by monopolizing their licensed to make or use the patent. This can be demonstrated in the Medtronic Sofamor Danek, Inc. v. Michelson case. Dr. Michelson had invented a new spinal treatment device and had given a license to Medtronic which manufactured medical equipment. However, the company did not promote his treatment device, and hence the doctor had to grant licenses to other companies that would compete with the original license holder.  The company filed a case in the court claiming that the patent holder breached clauses of the contract. However, the Court felt that the company had adopted certain anticompetitive principles that did not promote the patent. Patent holders are trying to maximize their monopoly, by indulging in anticompetitive acts. Often there is a clash between patent laws and antitrust laws. Patent laws provide the holder with rights to eliminate competition, whereas antitrust laws enable protection of healthy business competition practices. A clear border line has to be drawn between these two conflicting legal regimes.  In the case Illinois Tools Works V. Independent Ink, the question of the manufacturer having a market power over a patented product or process could be presumed whilst granting the patent, was being asked. A patent holder may hold so much of powers in the market such that he/she may dominate the scene. A patent holder will usually violate antirust laws if he or she feels that they are in a situation to dominate the market. In this case, Illinois printers invented a printing device and had prohibited the customers from using non-patented ink.  The defendant felt that such terms were against the true spirits of competition, and were under the impression that Illinois tool works were trying to dominate the market situation. It may be difficult in such a case to determine the party that would carry the burden of proof. The patent holder had tried to extend his patent. In this manner, they had created both, primary and secondary market rivals. The primary rivals included other manufacturers of printers, and the secondary rivals included other manufacturers of printer inks.  The court gave its decision in favor of Independent Ink, citing that patents could not be extended to non-patentable areas. A patent had only specific boundaries, and crossing such boundaries constituted infringement. In another case, Schering-Plough held a patent for a drug. A company that manufactured a generic version of the same drug felt that the original companyââ¬â¢s patent was invalid. They wanted to file for a patent opposition, but Schering-Plough decided to pay the generic drug manufacturers to withdraw the case and also stay out of the market for some period.  Federal Trade Commission filed a case before the Supreme Court, saying that Schering-Plough was trying to destroy all competition in the market by wrongfully preserving its invalid monopoly. The Court felt that the agreement between Schering-Plough and the generic manufacturers was invalid and was executed to destroy competition in the market. Patent laws should make it easier to obtain a compulsory license in case the patentee wrongfully suppresses the invetion from the public.  A compulsory license should be given to anybody in case:- The patentee is unable to meet the reasonable requirements of the public with relation to his patented process or product. â⬠¢ The patentee does not make the invention available to the public at an affordable cost. â⬠¢ The invention is not being worked in the jurisdiction of the patent office. â⬠¢ Special considerations should be given to inventions that relate to public health and nutrition, and emergency situations. Compulsory license should be a sanction (for the patentee) and a remedy (for the public); in case the patentee indulges in anticompetitive practices.  The concept of compulsory licenses developed following the African AIDS crisis situation. The continent was in a crisis situation with the HIV/AIDS pandemic. A few companies such as Glaxo, Merck, etc held a patent for an antiretroviral drug which could be life-saving for people suffering from HIV/AIDS. However, these companies had indulged in several anticompetitive practices. The cost of treating each AIDS patients in Africa was exceedingly high (US$ 10,000 per patient per year). Hence, the drugs were inaccessible for many poor patients who belonged to underdeveloped nations.  Cipla, an Indian pharmaceutical company volunteered to supply the drug at a fraction of the overall costs the other companies were offering (US $ 350 per year per patient). Some of the African Nations had to modify its trade laws so that parallel imports and compulsory licenses could exist. However, the original companies that held the patents for antiviral drugs began to sue for infringement. These companies had to later withdraw their infringement cases, as there was a worldwide agitation against the anti-public health policies adopted by the patent holders.  Later, at the WTO conference in Doha, a comprehensive agreement to protect public health issues was adopted to prevent unhealthy practices by the patent holders (through compulsory licenses). Some people feel that the patent system can create an obstruction in the development of science and technology, as instances of nonuse often arise. Once a patent is granted, it may even prevent others from inventing around a particular invention or inventive concept. This will seriously hinder the developments in that particular field. Inventors, who tend to sit on their inventions by refusing access to the public, should be henceforth refused patents.

It will become evident both ideologies are deeply torn when it comes to the state and its role in society. Although the different branches of liberals do not hold exactly the same vision of the state, they both agree that it is a necessary tool. On the other hand different forms of socialism completely disagree about the state, not only are these views ineligible for an implemented ideology, these deep divisions would likely later cause problems.
